1. About these terms

These terms apply when you use ZipCourse, at zipcourse.app. ZipCourse is run by legal name of the business ("we", "us"). Our address is postal address. You can email us at support@zipcourse.app.

By creating an account you agree to these terms. If you are using ZipCourse for an organisation, you agree on its behalf and confirm you're allowed to. Some parts apply differently to consumers (people using ZipCourse outside their trade or business) and to businesses; we say where.

2. What ZipCourse provides

ZipCourse is a course builder that runs in your web browser. Building, branding and previewing courses is free and needs no account. Exporting a course as a package for a learning management system (LMS) needs an account and uses credits.

The editor keeps your courses on your own computer, in your browser's storage and in course files you save. We don't receive or store them, so we can't recover a course if you clear your browser's data or lose a course file. Keep backups with Save.

3. Your account

  • An account is for one person, identified by their email address. You sign in with codes we email to that address, so keep your email account secure.
  • You must be 18 or over to create an account or buy credits.
  • You can change your sign-in email, sign out devices, download your data or delete your account at any time from Account in the editor.
  • We may put an account on hold while we look into a payment dispute, suspected fraud or a breach of these terms. We'll tell you why unless the law or an investigation stops us.

4. Credits

  • One credit exports one course. It covers every format we offer, downloading the same version again, and up to 10 edited versions of that course. A version counts as an edit when at least 50% of it matches the last version paid for; otherwise it is a new course and uses a new credit.
  • Credits last 12 months from the day you buy them, and the ones expiring soonest are used first. We email you 30 days before credits expire unless you turn that off.
  • Credits aren't money: they can't be exchanged for cash (except by refund under section 7), transferred to another account or resold.
  • If an account's first payment is unusually large, we may check it by hand before the credits are ready. This takes no more than one working day.

5. ZipCourse Pro

  • Pro is a subscription that adds credits each time it is paid, monthly or yearly. It renews automatically until you cancel it.
  • You can cancel at any time from Account, under Billing. Pro then stays on until the end of the period you've paid for, and you aren't charged again. Credits you've received stay until they expire.
  • If we change the price or credits of your plan, we'll email you at least 30 days before it affects your next payment, and you can cancel before then.
  • Credits from Pro follow the same rules as other credits, including refunds of unused credits.

6. Prices and payment

Prices are shown on our pricing page and at checkout, including VAT or sales tax where it applies. Payments are processed by Stripe through Stripe Managed Payments. For your purchase, Stripe acts as the merchant of record: it takes the payment, issues the receipt and handles sales tax and VAT, and its own terms for the payment also apply. We never see your card details.

7. Your right to cancel, and refunds

If you are a consumer, you normally have 14 days to cancel a purchase of digital content. When you buy credits we ask you to agree that they are available straight away, and that you lose the right to cancel for each credit once you use it. We supply the credits only once you've agreed.

Our refund policy goes further than the law requires for unused credits: you can refund them within 14 days of buying them, from Account. Credits you've used can't be refunded, except under section 11.

8. Your content

  • Your courses, and everything you put in them, stay yours. We don't receive them and claim no rights over them.
  • You are responsible for having the rights to use what you put in a course: text, pictures, video, music, logos and fonts.
  • When you export, we receive a random course ID and one-way fingerprints of the course, which we keep to know what you've paid for. They can't be turned back into your content.

9. Exported packages

  • You may use, copy and share each package you export, for any number of learners, on any number of LMSs or websites, for as long as you like. Packages don't expire.
  • Each package contains our course player and a licence for that version of the course. The player stays ours; you may use it only as part of the package it came in.
  • Don't remove, disable or work around the licence check, or change the player. If a package's files are changed after export, the player stops working: export the changed course again instead.

10. Using ZipCourse fairly

Don't use ZipCourse to make or share anything unlawful, harmful or that infringes someone else's rights; to attack, overload or probe our service, beyond good-faith security research reported to us; or to resell credits or accounts. We may suspend or close an account that does.

11. If something goes wrong

If you are a consumer, the Consumer Rights Act 2015 says digital content must be as described, fit for purpose and of satisfactory quality. If an export doesn't work as it should, email us: we'll fix it or, if we can't within a reasonable time, give the credit back or refund it. If faulty digital content we supplied damages your device or other digital content, and we didn't use reasonable care and skill, we'll repair the damage or compensate you.

Whatever kind of customer you are, if a package doesn't do what our website says, tell us and we'll put it right. Nothing in these terms affects your legal rights.

12. Our responsibility to you

We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that wasn't foreseeable, or that was caused by events outside our reasonable control.

If you are a consumer, we supply ZipCourse for your personal use; if you use it for a business, we have no liability to you for loss of profit, business or opportunity.

If you are a business, our total liability to you under or in connection with these terms is limited to the amount you paid us in the 12 months before the claim arose, and we are not liable for loss of profit, revenue, business, goodwill or data, or for indirect loss.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit.

13. Changes and ending

  • We improve ZipCourse often. If a change would significantly reduce what your unused credits buy, we'll tell you first and you can refund them, whatever the date.
  • We aim to keep ZipCourse available but can't promise it will never be interrupted. Exported packages don't depend on our service.
  • We may update these terms. We'll email you at least 30 days before a change that affects you materially; if you don't agree, you can refund unused credits and close your account before it takes effect.
  • You can delete your account at any time. If we close your account for a reason that isn't your fault, we'll refund your unused credits.

14. Law and disputes

These terms are governed by the law of England and Wales. If you are a consumer, you can bring a claim in the courts of England and Wales, or of Scotland or Northern Ireland if you live there, and you keep the protection of the mandatory consumer law where you live. If you are a business, the courts of England and Wales have exclusive jurisdiction.
